Supreme court rulings

The supreme court made two rulings today regarding medicinal use of marijuana.

Interestingly, I agree with one of them. The court ruled 8-0 that a Federal law prohibiting the medical use/distribution of marijuana is legal. I agree. I wholehearted disagree with the law, but do think it’s an inherently legislative matter and should not be the role of the court to decide such things ( any more than they should decide Presidential elections, but they’d never do that, right? ;-) ).

It does open a rather interesting door, in that it seems to suggest it’s perfectly legal for Congress to make legislation that exerts control over what is and isn’t acceptable/allowable in the medical profession — and that’s bound to be an area that will be touchy in the future.

The truly disturbing decision, however, is a 5-3 ruling agreeing that it can be illegal to introduce illness and medical conditions in a criminal defense against a charge of marijuana possession. This seems to undercut the very nature of our jury system, which is based on the ability to fairly present facts to a jury ( from both sides ) and allow them to make a decision in a specific case.

The future of the court after another one or two conservative nominees is a serious concern on mine. Even half a dozen more critical decisions of this nature could really do rather severe damage to our already painfully curtailed “Freedom” in America.
